Chapter 1: General Provision. Article 774 Succession is a mode of acquisition by virtue of which the property, rights and obligations to the extent of the value of the inheritance of a person are transmitted through his death to another or others either by his will or by operation of law.
Succession requires: 1) the death of the decedent, 2) transmissible property/rights, and 3) heirs capable of inheriting. The inheritance includes all the decedent's property, rights and obligations at death, as well as any accrued since. Successional rights are transmitted at the moment of death.
